USU's Faculty of Law Promotes Environmental Lawsuit Rights in Pardamean Sibisa Village

The event, titled "Improving Public Understanding of the Right to Sue Model for Perpetrators of Environmental Pollution and/or Destruction in Pardamean Sibisa Village," was led by Prof. Dr. Suhaidi, SH., MH., along with Riadhi Alhayyan, SH, MH, Dr. Jelly Leviza, SH, M.Hum., and four USU Law Faculty students: Anzelina Sianipar, Gabriel Eqqi Churchin Simbolon, Paskel CH Pratama GM, and Lola Olivia Sihotang.

The outreach aimed to increase community understanding of environmental issues and the legal remedies available in the event of environmental pollution or destruction. The event was attended by representatives of the Pardamean Sibisa Village Head, Maringan Sirait, and residents from various backgrounds. The event began with remarks by Prof. Suhaidi, followed by a presentation on "The Right to Sue in Environmental Law." Dr. Jelly Leviza explained the various types of rights to sue under Law No. Law No. 32 of 2009 concerning Environmental Protection and Management (UUPPLH): "If we look at Law No. 32 of 2009 concerning Environmental Protection and Management (UUPPLH), in Articles 90-92 concerning the Right to Sue for the Environment, we need to understand that there are several types of rights to file a lawsuit under Law No. 32 of 2009 concerning environmental protection and management: the right to sue the community in the form of class actions (Article 91), the right to sue the government (Article 90), and the right to sue environmental organizations (Article 92)," he explained.

Riadhi Alhayyan explained the difference between class action lawsuits and environmental organizations' lawsuits: "Class action lawsuits are different from environmental organizations' lawsuits. Class action lawsuits, consisting of Class Representatives and Class Members, represent victims who have suffered real losses, while Environmental Organizations act as plaintiffs or represent the interests of environmental preservation. We need to understand that Class Action Lawsuits generally result in claims for compensation, while environmental organizations' lawsuits are limited to demands for specific actions without claims for compensation," he said. After the question-and-answer session, the team presented plaques, souvenirs, and pocket books. The event concluded with a communal meal, which was enthusiastically received by the community.

Prof. Suhaidi hopes this outreach will increase community awareness of environmental lawsuit rights and encourage active participation in protecting the environment in Pardamean Sibisa Village. "Hopefully, this community service activity will increase public knowledge regarding the Right to Sue in Environmental Law, and encourage the community to actively participate in protecting and preserving the environment in Pardamean Sibisa Village," he concluded.
